Refund Policy:
1. Prior to Entering into a Gestational Carrier Agreement. Due to the personal and subjective nature of the surrogacy process, Agency may determine that it is unable to develop a satisfactory professional relationship with the Intended Parent(s). Accordingly, Agency may, in its sole discretion, terminate this Agreement upon ten (10) days written notice to Intended Parent(s) with no further responsibility or liability on behalf of Agency. In the event of such termination, Agency shall refund any Agency’s Fees already paid by Intended Parent(s) less the non-refundable good faith deposit and any Gestational Carrier related expenses paid by the Agency.
2. After entering into a Gestational Carrier Agreement, Agency may, in its sole discretion, terminate this Agreement if in the Agency’s good faith opinion, Intended Parent(s) acted unreasonably. Ten (10) days written notice will be given to Intended Parent(s) with no further responsibility or liability on behalf of the Agency. In the event of such termination, Agency shall refund any unused Agency’s Fees already paid by Intended Parent(s). For the purpose of clarification, Agency’s Fees shall be deemed non-refundable as follows: 25% upon an embryo transfer, 25% upon confirmation of heartbeat, 25% upon Gestational Carrier’s medical care being transferred to her OBGYN, and 25% based on 6 months from confirmation of heartbeat.
Timing of refunding unused journey funds:
